The Ministry of Justice is consulting on a draft statutory instrument, made under the Tribunals, Courts and Enforcement Act 2007 relating to eligibility for judicial appointment.

The Act revises the statutory eligibility requirements for judicial appointment, and contains order-making powers enabling the Lord Chancellor to specify 'relevant qualifications', so that persons other than barristers and solicitors may become eligible to apply for judicial office.

The draft statutory instrument sets out the categories of judicial office for which Fellows of the Institute of Legal Executives, registered patent agents and registered trade mark agents are eligible.

Timeframe

This consultation started on 5th February 2008 and ended on 29th April 2008.
